Trial By Declaration

This court requires that you post bail prior to trial by declaration. A trial by declaration is a method of contesting your citation that is allowed by §40902 CVC. It requires that you and the officer put your statements in writing and the Judge reads these statements and determines the outcome of the case. You will be notified of the decision by mail. Forms for a trial by declaration may be obtained from the court or from http://www.courts.ca.gov/forms.htm. Submit your completed forms along with any other evidence you wish the court to consider. The court will present the officer with a form to complete for his/her statement. If you request a trial by declaration be advised you automatically waive time.
